Raymond Carré de Malberg a durablement marqué la doctrine constitutionnaliste française autant par sa méthodologie se voulant épurée de la philosophie et de la politique que par sa définition formelle de la constitution. La conviction principale que ces deux approches nous ont légué est l’assimilation entre texte constitutionnel et système de gouvernement, conviction que l’auteur défend brillamment dans son analyse des trois lois constitutionnelles de 1875. C’est justement de cette analyse que nous avons souhaité partir afin de dévoiler les contradictions entre les postulats méthodologiques de l’auteur et le fond de sa réflexion. Loin de se limiter à une simple déconstruction, cette entreprise vise à révéler la véritable notion de constitution présente dans l’œuvre de Carré de Malberg – celle de système constitutionnel - pour en tirer des enseignements plus généraux sur l’articulation entre constitution et système de gouvernement.
Constitution and System of Government in Raymond Carré de Malberg. Raymond Carré de Malberg has had a long-lasting influence on the French constitutionalist doctrine as much by his methodology meant to be purged of philosophy and politics as by his formal definition of the constitution. The main conviction bequeathed by these two approaches is the assimilation between the constitutional text and the system of government. This conviction is brilliantly argued for by Raymond Carré de Malberg in his analysis of the 1875 three Constitutional Laws. Indeed, we have chosen to start from this analysis to unveil the contradictions between this author’s methodologic premises and the core of his reflection/thought. Far from being limited to a simple deconstruction, this work aims at revealing the real notion of the constitution present in Carré de Malberg’s work – that of a constitutional system- in order to derive from it more general teachings about the articulation between constitution and system of government.
