Les constitutions de l’Interrègne en Angleterre (I) : l’Instrument of Government (1653), texte anglais et traduction française présentés par Renan Le Mestre

Suite à  la dissolution manu militari du Parlement croupion, le 20 avril 1653, par Cromwell, le Conseil des officiers de la New Model Army charge une assemblée de 140 membres, le Barebone’s Parliament (ainsi appelé en référence à  un de ses membres ; Praise-God Barbon), de rédiger une constitution. Fortement divisés entre Radicaux, Modérés et Conservateurs, les constituants se révèlent vite incapables de s’acquitter de leur tâche, et la majorité d’entre eux décide, le 12 décembre 1653, de renoncer à  ses pouvoirs au profit de Cromwell.

Inspirée par les Heads of the Proposals de 1647 (concessions exigées par l’Armée de Charles I, alors son prisonnier, à  l’issue de la première guerre civile, comme préalable à  sa restauration) et par l’Agreement of the People de 1649 (propositions constitutionnelles d’inspiration démocratique avancées par la frange la plus éclairée de l’Armée ; les Levellers), la nouvelle constitution, appelée Instrument of Government, est approuvée, le 16 décembre 1653, par le Conseil des officiers.

Ses Institutions partiellement indépendantes les unes des autres sont un Parlement monocaméral investi du droit de voter la loi et de lever l’impôt, qui doit se réunir au moins une fois tous les trois ans ; le Lord Protecteur chargé de la fonction gouvernementale qui est élu à  vie (la constitution attribuant cette fonction à  Cromwell) ; un Conseil permanent de vingt-et-un membres au maximum se cooptant qui assiste le Lord Protecteur dans l’exercice de ses fonctions et peut, dans certaines circonstances, se substituer, lorsqu’il n’est pas réuni, au Parlement.

Ce premier Protectorat n’est pas dominé par la figure du Lord Protecteur, même si la création de cette fonction signale l’abandon de la pratique suivie depuis 1641, concentrant l’ensemble des pouvoirs au profit du seul Parlement siégeant en permanence, lequel déléguait la fonction exécutive à  un gouvernement collégial (le Conseil d’État). L’organe-clé en est, au contraire, le Conseil, dont la majorité des membres appartient à  l’Armée, ce qui garantit à  cette dernière le maintien de sa prépondérance en matière politique. Le Lord Protecteur ne peut, en effet, exercer ses prérogatives les plus essentielles qu’après avoir demandé son avis ou obtenu son accord. Ce rôle de contrepoids se retrouve s’agissant du Parlement, dans le processus de convocation duquel il intervient, dont il valide l’élection des membres, et qu’il peut même remplacer.

Le premier Parlement du Protectorat, réuni en septembre 1654, tente d’amender les dispositions de la constitution relatives à  l’armée de terre (30.000 hommes sous le contrôle du Lord Protecteur) et à  la tolérance religieuse en faveur des Independents, tout en refusant de ratifier les ordonnances prises par le gouvernement depuis décembre 1653. Il est dissous, le 22 janvier 1655, par Cromwell. Ce dernier divise alors, en octobre 1655, le pays en 12 régions, chacune placée sous la direction d’un major-général directement responsable devant lui. Face à  un déficit financier énorme qu’entretient la poursuite de la guerre contre l’Espagne, il est toutefois contraint de renoncer à  cette expérience de plus en plus impopulaire et de convoquer, en mai 1656, un nouveau Parlement, lequel, avec son accord, substitue, le 25 mars 1657, à  l’Instrument of Government, une nouvelle constitution ; l’Humble Petition and Advice.

INSTRUMENT OF GOVERNMENT (1653)

|The government of the Commonwealth of England, Scotland, and Ireland, and the dominions thereunto belonging.

|Le gouvernement de la République d’Angleterre, d’Écosse et d’Irlande et de leurs dépendances. |

|I. That the supreme legislative authority of the Commonwealth of England, Scotland, and Ireland, and the dominions thereunto belonging, shall be and reside in one person, and the people assembled in Parliament; the style of which person shall be the Lord Protector of the Commonwealth of England, Scotland, and Ireland.

L’autorité législative suprême de la République d’Angleterre, d’Écosse et d’Irlande et de leurs dépendances reviendra à  une seule personne et au peuple assemblé en Parlement ; le titre de cette personne sera Lord Protecteur de la République d’Angleterre, d’Écosse et d’Irlande et de leurs dépendances. |

|II. That the exercise of the chief magistracy and the administration of the government over the said countries and dominions, and the people thereof, shall be in the Lord Protector, assisted with a council, the number whereof shall not exceed twenty - one, nor be less than thirteen.

|II. L’exercice de la magistrature suprême et du gouvernement des pays et dépendances susmentionnés ainsi que de leur population sera confié au Lord Protecteur assisté d’un Conseil dont le nombre de membre n’excédera pas 21, ni ne sera inférieur à  13.

|III. That all writs, processes, commissions, patents, grants, and other things, which now run in the name and style of the keepers of the liberty of England by authority of Parliament, shall run in the name and style of the Lord Protector, from whom, for the future, shall be derived all magistracy and honours in these three nations; and have the power of pardons (except in case of murders and treason) and benefit of all forfeitures for the public use; and shall govern the said countries and dominions in all things by the advice of the council, and according to these presents and the laws.

|III. Les lettres, les procédures, les commissions, les brevets, les concessions et autres documents actuellement délivrés, en vertu de l’autorité du Parlement, au nom des Gardiens de la liberté de l’Angleterre le seront dorénavant au nom du Lord Protecteur, source, à  l’avenir, de toute autorité administrative et des distinctions honorifiques dans les trois Nations. Le Lord Protecteur exercera, hormis les cas de meurtre et de trahison, le droit de grâce et se verra attribuer le produit des confiscations, afin de l’utiliser au service de la collectivité. Il gouvernera lesdits pays et dépendances en toutes choses suivant l’avis du Conseil, dans le respect du présent texte et des lois.

|IV. That the Lord Protector, the Parliament sitting, shall dispose and order the militia and forces, both by sea and land, for the peace and good of the three nations, by consent of Parliament; and that the Lord Protector, with the advice and consent of the major part of the council, shall dispose and order the militia for the ends aforesaid in the intervals of Parliament.

Le Lord Protecteur, lorsque le Parlement est en session, n’utilisera la milice et les forces armées, terrestres comme maritimes, et ne leur donnera d’instructions, pour la paix et le bien des trois Nations, qu’après avoir recueilli l’accord parlementaire. Il ne le fera, pour les fins précitées, durant l’intervalle entre deux législatures, qu’après avoir consulté le Conseil et recueilli l’accord de la majorité de ses membres.

|V. That the Lord Protector, by the advice aforesaid, shall direct in all things concerning the keeping and holding of a good correspondency with foreign kings, princes, and states; and also, with the consent of the major part of the council, have the power of war and peace.

|VI. That the laws shall not be altered, suspended, abrogated, or repealed, nor any new law made, nor any tax, charge, or imposition laid upon the people, but by common consent in Parliament, save only as is expressed in the thirtieth article.

|VII. That there shall be a Parliament summoned to meet at Westminster upon the third day of September, 1654, and that successively a Parliament shall be summoned once in every third year, to be accounted from the dissolution of the present Parliament.

|VIII. That neither the Parliament to be next summoned, nor any successive Parliaments, shall, during the time of five months, to be accounted from the day of their first meeting, be adjourned, prorogued, or dissolved, without their own consent.

|IX. That as well the next as all other successive Parliaments, shall be summoned and elected in manner hereafter expressed; that is to say, the persons to be chosen within England, Wales, the Isles of Jersey, Guernsey, and the town of Berwick - upon - Tweed, to sit and serve in Parliament, shall be, and not exceed, the number of four hundred. The persons to be chosen within Scotland, to sit and serve in Parliament, shall be, and not exceed, the number of thirty; and the persons to be chosen to sit in Parliament for Ireland shall be, and not exceed, the number of thirty.

That the persons to be elected to sit in Parliament from time to time, for the several counties of England, Wales, the Isles of Jersey and Guernsey, and the town of Berwick - upon - Tweed, and all places within the same respectively, shall be according to the proportions and numbers hereafter expressed: that is to say,

|XI. That the summons to Parliament shall be by writ under the Great Seal of England, directed to the sheriffs of the several and respective counties, with such alteration as may suit with the present government, to be made by the Lord Protector and his council, which the Chancellor, Keeper, or Commissioners of the Great Seal shall seal, issue, and send abroad by warrant from the Lord Protector. If the Lord Protector shall not give warrant for issuing of writs of summons for the next Parliament, before the first of June, 1654, or for the Triennial Parliaments, before the first day of August in every third year, to be accounted as aforesaid; that then the Chancellor, Keeper, or Commissioners of the Great Seal for the time being, shall, without any warrant or direction, within seven days after the said first day of June, 1654, seal, issue, and send abroad writs of summons (changing therein what is to be changed as aforesaid) to the several and respective sheriffs of England, Scotland, and Ireland, for summoning the Parliament to meet at Westminster, the third day of September next; and shall likewise, within seven days after the said first day of August, in every third year, to be accounted from the dissolution of the precedent Parliament, seal, issue, and send forth abroad several writs of summons (changing therein what is to be changed) as aforesaid, for summoning the Parliament to meet at Westminster the sixth of November in that third year. That the said several and respective sheriffs, shall, within ten days after the receipt of such writ as aforesaid, cause the same to be proclaimed and published in every market - town within his county upon the market - days thereof, between twelve and three of the clock; and shall then also publish and declare the certain day of the week and month, for choosing members to serve in Parliament for the body of the said county, according to the tenor of the said writ, which shall be upon Wednesday five weeks after the date of the writ; and shall likewise declare the place where the election shall be made: for which purpose he shall appoint the most convenient place for the whole county to meet in; and shall send precepts for elections to be made in all and every city, town, borough, or place within his county, where elections are to be made by virtue of these presents, to the Mayor, Sheriff, or other head officer of such city, town, borough, or place, within three days after the receipt of such writ and writs; which the said Mayors, Sheriffs, and officers respectively are to make publication of, and of the certain day for such elections to be made in the said city, town, or place aforesaid, and to cause elections to be made accordingly.

|XI. La convocation du Parlement sera effectuée par une lettre revêtue du Grand sceau d’Angleterre, adressée aux sheriffs des différents comtés, selon des formes et procédures mises à  jour pour tenir compte du gouvernement actuel, par le Lord Protecteur et son Conseil, que le Chancelier, le Gardien ou les commissaires du Grand sceau produiront, scelleront et expédieront sur ordre du Lord Protecteur. Si ce dernier ne le fait pas, s’agissant du prochain Parlement, avant le 1er juin 1654 ou, s’agissant des Parlement triennaux, avant le premier jour d’août, une fois tous les trois ans, le Chancelier, le Gardien ou les commissaires du Grand sceau produiront, scelleront et expédieront ladite lettre (avec les modifications précédemment envisagées) aux différents sheriffs d’Angleterre, d’Écosse et d’Irlande afin d’inviter le Parlement à  se réunir à  Westminster le troisième jour du prochain mois de septembre. Ils feront de même, dans les sept jours suivant ledit premier jour d’août, une fois tous les trois ans, à  compter de la dissolution du précédent Parlement, en vue d’une réunion à  Westminster le sixième jour de novembre de cette troisième année. Les sheriffs, dans les dix jours de la réception de ladite lettre, la feront lire publiquement dans chaque ville de marché de leur comté, les jours de marchés, entre midi et trois heures de l’après-midi et feront alors aussi connaître le jour précis de désignation des députés devant représenter ledit comté au sein du Parlement, conformément au contenu de la lettre, à  savoir le mercredi de la cinquième semaine suivant la réception de cette dernière. Ils choisiront comme lieu de l’élection l’endroit le plus propre à  une réunion du corps électoral du comté tout entier et adresseront, dans les trois jours, pour la tenue des élections dans chaque cité, ville, bourg ou endroit au sein du comté où elles doivent avoir lieu en vertu du présent texte des consignes au maire, au sheriff ou à  tout autre magistrat supérieur, lesquels les feront proclamer ainsi que le jour exact de tenue de l’élection dans la ville, cité ou lieu susmentionnés et organiseront le scrutin en conséquence.

|XII. That at the day and place of elections, the Sheriff of each county, and the said Mayors, Sheriffs, Bailiffs, and other head officers within their cities, towns, boroughs, and places respectively, shall take view of the said elections, and shall make return into the chancery within twenty days after the said elections, of the persons elected by the greater number of electors, under their hands and seals, between him on the part, and the electors on the other part; wherein shall be contained, that the persons elected shall not have power to alter the government as it is hereby settled in one single person and a Parliament.

|XII. Au jour et au lieu dits, le sheriff de chaque comté et les maires, sheriffs, baillis et autres magistrats supérieurs de leurs cités, villes, bourgs et autres lieux surveilleront la tenue du scrutin et communiqueront, sous leurs seing et sceau, dans les vingt jours, à  la Chancellerie la liste des personnes élues par le plus grand nombre d’électeurs, où il sera indiqué que les élus n’auront pas la capacité d’altérer le gouvernement, tel qu’établi dans le présent texte, reposant sur une seule personne et un Parlement.

|XIII. That the Sheriff, who shall wittingly and willingly make any false return, or neglect his duty, shall incur the penalty of 2000 marks of lawful English money; the one moiety to the Lord Protector, and the other moiety to such person as will sue for the same.

|XIII. Le sheriff, qui délibérément fera parvenir un faux résultat ou qui négligera son devoir, encourra une pénalité de 2000 marcs anglais ; la première moitié revenant au Lord Protecteur, la seconde à  la personne ayant engagé des poursuites.

|XIV. That all and every person and persons, who have aided, advised, assisted, or abetted in any war against the Parliament, since the first day of January 1641 (unless they have been since in the service of the Parliament, and given signal testimony of their good affection thereunto) shall be disabled and incapable to be elected, or to give any vote in the election of any members to serve in the next Parliament, or in the three succeeding Triennial Parliaments.

|XIV. Toute personne ayant prêté son concours, donné des conseils, assisté ou encouragé une guerre contre le Parlement, depuis le premier jour de janvier 1641 (sauf si, depuis lors, elle a servi le Parlement et donné des signes manifestes d’attachement à  son égard), sera inéligible et privée de tout droit de vote lors de la désignation des membres du prochain Parlement comme des trois parlements triennaux suivants.

|XV. That all such, who have advised, assisted, or abetted the rebellion of Ireland, shall be disabled and incapable for ever to be elected, or give any vote in the election of any member to serve in Parliament; as also all such who do or shall profess the Roman Catholic religion.

|XV. Tous ceux ayant donné des conseils, assisté ou encouragé la rébellion de l’Irlande seront privés à  vie du droit d’éligibilité et du droit de vote lors de l’élection d’un membre du Parlement. Il en sera de même de ceux professant la religion catholique romaine.

|XVI. That all votes and elections given or made contrary, or not according to these qualifications, shall be null and void; and if any person, who is hereby made incapable, shall give his vote for election of members to serve in Parliament, such person shall lose and forfeit one full year's value of his real estate, and one full third part of his personal estate; one moiety thereof to the Lord Protector, and the other moiety to him or them who shall sue for the same.

|XVI. Les votes accordés ou les scrutins organisés contrairement à  ces qualifications seront nuls et de nul effet. Si une personne incapable de le faire en vertu de ces dispositions prend, malgré tout, part à  une élection d’un membre du Parlement, elle s’expose à  la confiscation d’une année de revenus de ses propriétés foncières et d’un tiers de ses biens meubles ; la première moitié revenant au Lord Protecteur, la seconde à  ou aux personnes ayant engagé des poursuites.

|XVII. That the persons who shall be elected to serve in Parliament, shall be such (and no other than such) as are persons of known integrity, fearing God, and of good conversation, and being of the age of twenty - one years.

|XVIII. That all and every person and persons seised or possessed to his own use, of any estate, real or personal, to the value of 200 pounds, and not within the aforesaid exceptions, shall be capable to elect members to serve in Parliament for counties.

|XIX. That the Chancellor, Keeper, or Commissioners of the Great Seal, shall be sworn before they enter into their offices, truly and faithfully to issue forth, and send abroad, writs of summons to Parliament, at the times and in the manner before expressed: and in case of neglect or failure to issue and send abroad writs accordingly, he or they shall for every such offence be guilty of high treason, and suffer the pains and penalties thereof.

Le Chancelier, le Gardien ou les commissaires du Grand sceau jureront, avant d’entrer en fonctions, d’établir et d’expédier la lettre de convocation du Parlement, aux époques et selon la forme ci-dessus exposée. |XX. That in case writs be not issued out, as is before expressed, but that there be a neglect therein, fifteen days after the time wherein the same ought to be issued out by the Chancellor, Keeper, or Commissioners of the Great Seal; that then the Parliament shall, as often as such failure shall happen, assemble and be held at Westminster, in the usual place, at the times prefixed, in manner and by the means hereafter expressed; that is to say, that the sheriffs of the several and respective counties, sheriffdoms, cities, boroughs, and places aforesaid, within England, Wales, Scotland, and Ireland, the Chancellor, Masters, and Scholars of the Universities of Oxford and Cambridge, and the Mayor and Bailiffs of the borough of Berwick - upon - Tweed and other places aforesaid respectively, shall at the several courts and places to be appointed as aforesaid, within thirty days after the said fifteen days, cause such members to be chosen for their said several and respective counties, sheriffdoms, universities, cities, boroughs, and places aforesaid, by such persons, and in such manner as if several and respective writs of summons to Parliament under the Great Seal had issued and been awarded according to the tenor aforesaid: that if the sheriff, or other persons authorized, shall neglect his or their duty herein, that all and every such sheriff and person authorized as aforesaid, so neglecting his or their duty, shall, for every such offence, be guilty of high treason, and shall suffer the pains and penalties thereof.

|XX. Dans le cas où la lettre ne serait pas établie, ainsi que prévu précédemment, quinze jours après la date à  laquelle elle aurait dû l’être par le Chancelier, le Gardien ou les commissaires du Grand sceau, le Parlement sera convoqué de droit, aussi souvent qu’une telle carence se produira, à  Westminster, à  l’endroit accoutumé, aux dates prédéterminées, conformément aux règles suivantes. Les sheriffs des différents comtés, sherifferies, cités, bourgs et localités susmentionnés d’Angleterre, du Pays de Galles, d’Écosse et d’Irlande, le Chancelier, les proviseurs des collèges et les diplômés des Universités d’Oxford et de Cambridge ainsi que le maire et les baillis du bourg de Berwick-upon-Tweed et autres lieux précités organiseront, dans les trente jours suivant l’expiration des quinze jours précités, aux emplacements précédemment indiqués, le choix des représentants de leur comté, sherifferie, université, cité, bourg et localités par les personnes habilitées à  le faire et selon la même procédure que si des lettres de convocation du Parlement revêtues du Grand sceau, reprenant ces conditions, avaient été établies et délivrées. Si le sheriff ou toute autre personne tenue d’organiser le scrutin néglige son devoir à  ce propos, ils se rendront coupables de haute-trahison et subiront le châtiment y afférant.

|XXI. That the clerk, called the clerk of the Commonwealth in Chancery for the time being, and all others, who shall afterwards execute that office, to whom the returns shall be made, shall for the next Parliament, and the two succeeding Triennial Parliaments, the next day after such return, certify the names of the several persons so returned, and of the places for which he and they were chosen respectively, unto the Council; who shall peruse the said returns, and examine whether the persons so elected and returned be such as is agreeable to the qualifications, and not disabled to be elected: and that every person and persons being so duly elected, and being approved of by the major part of the Council to be persons not disabled, but qualified as aforesaid, shall be esteemed a member of Parliament, and be admitted to sit in Parliament, and not otherwise.

|XXI. Le clerc, appelé actuellement clerc de la République à  la Chancellerie, et tous ceux qui, après lui, exerceront son office, auquel doivent être adressés les résultats des élections, certifiera, pour le prochain Parlement et ses deux successeurs, au Conseil, le lendemain du jour où chaque résultat lui sera parvenu, les noms des personnes élues et des circonscriptions les ayant désignées. Ce dernier prendra connaissance de l’ensemble des résultats et contrôlera que les personnes ainsi élues respectent bien les qualifications et ne sont pas inéligibles. Toute personne dûment élue et dont la majorité des membres du Conseil reconnaît qu’elle n’est pas incapable, mais, au contraire, qualifiée au regard des conditions précitées sera réputée membre du Parlement et admise à  y siéger, et pas autrement.

|XXII. That the persons so chosen and assembled in manner aforesaid, or any sixty of them, shall be, and be deemed the Parliament of England, Scotland, and Ireland; and the supreme legislative power to be and reside in the Lord Protector and such Parliament, in manner herein expressed.

Les personnes ainsi choisies et réunies dans les conditions précitées ou, à  défaut, au moins soixante d’entre elles formeront et seront réputées former le Parlement d’Angleterre, d’Écosse et d’Irlande. L’autorité législative suprême sera investie dans le Lord Protecteur et dans un Parlement, conformément au présent texte.

|XXIII. That the Lord Protector, with the advice of the major part of the Council, shall at any other time than is before expressed, when the necessities of the State shall require it, summon Parliaments in manner before expressed, which shall not be adjourned, prorogued, or dissolved without their own consent, during the first three months of their sitting. And in case of future war with any foreign State, a Parliament shall be forthwith summoned for their advice concerning the same.

|XXIII. Le Lord Protecteur, avec l’accord de la majorité des membres du Conseil, pourra, à  tout autre moment que celui précédemment envisagé, lorsque les nécessités de l’Etat le requerront, convoquer des Parlements de la façon précédemment décrite, lesquels ne pourront être ajournés, prorogés ou dissous sans leur consentement au cours de leurs trois premiers mois d’existence. En cas de guerre avec un État étranger, un Parlement sera immédiatement convoqué afin de recueillir l’avis de ses membres à  ce sujet.

|XXIV. That all Bills agreed unto by the Parliament, shall be presented to the Lord Protector for his consent; and in case he shall not give his consent thereto within twenty days after they shall be presented to him, or give satisfaction to the Parliament within the time limited, that then, upon declaration of the Parliament that the Lord Protector hath not consented nor given satisfaction, such Bills shall pass into and become laws, although he shall not give his consent thereunto; provided such Bills contain nothing in them contrary to the matters contained in these presents.

|XXIV. Tous les projets de loi approuvés par le Parlement seront présentés à  la sanction du Lord Protecteur. Si ce dernier n’y donne pas son consentement dans les vingt jours ou ne fournit pas d’explications jugées satisfaisantes dans ce délai, de tels projets acquerront, malgré cela, pleine et entière force législative, après déclaration par le Parlement que le Lord Protecteur n’a ni donné sa sanction, ni fourni d’explications satisfaisantes à  son refus de le faire, à  condition, toutefois, que ces projets ne contiennent rien de contraire aux dispositions du présent texte.

|XXV. That (…) [names of the fifteen members] or any seven of them, shall be a Council for the purposes expressed in this writing; and upon the death or other removal of any of them, the Parliament shall nominate six persons of ability, integrity, and fearing God, for every one that is dead or removed; out of which the major part of the Council shall elect two, and present them to the Lord Protector, of which he shall elect one; and in case the Parliament shall not nominate within twenty days after notice given unto them thereof, the major part of the Council shall nominate three as aforesaid to the Lord Protector, who out of them shall supply the vacancy; and until this choice be made, the remaining part of the Council shall execute as fully in all things, as if their number were full. And in case of corruption, or other miscarriage in any of the Council in their trust, the Parliament shall appoint seven of their number, and the Council six, who, together with the Lord Chancellor, Lord Keeper, or Commissioners of the Great Seal for the time being, shall have power to hear and determine such corruption and miscarriage, and to award and inflict punishment, as the nature of the offence shall deserve, which punishment shall not be pardoned or remitted by the Lord Protector; and, in the interval of Parliaments, the major part of the Council, with the consent of the Lord Protector, may, for corruption or other miscarriage as aforesaid, suspend any of their number from the exercise of their trust, if they shall find it just, until the matter shall be heard and examined as aforesaid.

|XXV. [Noms des quinze membres du Conseil] ou sept d’entre eux formeront un Conseil pour satisfaire aux buts exprimés dans ce texte. En cas de décès ou de retrait d’un d’entre eux, le Parlement proposera, pour chaque vacance, six personnes de capacité, d’intégrité, ayant la crainte de Dieu, parmi lesquelles le Conseil en choisira deux à  la majorité, dont il présentera les noms au Lord Protecteur qui en retiendra un. Si le Parlement ne s’acquitte pas de cette tâche dans les vingt jours de la notification, le Conseil, à  la majorité, proposera trois noms au Lord Protecteur qui désignera l’un d’entre eux pour pourvoir la vacance. Jusqu’à  ce que cette nomination intervienne, le Conseil exécutera l’intégralité de ses missions comme si son effectif était au complet. En cas de corruption ou de manquement aux devoirs de sa charge de la part d’un membre du Conseil, le Parlement nommera sept et le Conseil six de ses membres, lesquels auront avec le Lord Chancelier, le Gardien ou les commissaires du Grand sceau pouvoir d’établir, après audition, un tel agissement et de le punir comme il le mérite ; cette sanction ne pouvant donner lieu à  exercice par le Lord Protecteur du droit de grâce ou à  amnistie. Dans l’intervalle de temps entre deux Parlements, le Conseil, à  la majorité, avec l’accord du Lord Protecteur pourra, pour corruption ou autres manquements susenvisagés, suspendre un de ses membres, s’il l’estime juste, jusqu’à  ce que l’affaire soit en mesure d’être entendue publiquement et examinée dans les conditions précédemment mentionnées.

|XXVI. That the Lord Protector and the major part of the Council aforesaid may, at any time before the meeting of the next Parliament, add to the Council such persons as they shall think fit, provided the number of the Council be not made thereby to exceed twenty - one, and the quorum to be proportioned accordingly by the Lord Protector and the major part of the Council.

|XXVI. Le Lord Protecteur et la majorité du Conseil sont autorisés, à  n’importe quel moment avant la réunion du prochain Parlement, à  compléter le Conseil par toutes personnes qu’ils jugent bonnes, pourvu que l’effectif du conseil n’excède pas vingt-un ; le quorum étant adapté en conséquence par le Lord Protecteur et la majorité du Conseil.

|XXVII. That a constant yearly revenue shall be raised, settled, and established for maintaining of 10,000 horse and dragoons, and 20,000 foot, in England, Scotland and Ireland, for the defence and security thereof, and also for a convenient number of ships for guarding of the seas; besides 200,000 Pounds per annum for defraying the other necessary charges of administration of justice and other expenses of the Government, which revenue shall be raised by the customs, and such other ways and means as shall be agreed upon by the Lord Protector and the Council, and shall not be taken away or diminished, nor the way agreed upon for raising the same altered, but by the consent of the Lord Protector and the Parliament.

|XXVII. Un revenu annuel constant sera levé, fixé et établi pour maintenir 10 000 cavaliers et dragons et 20 000 fantassins en Angleterre, Écosse et Irlande pour leur défense et sécurité ainsi qu’un nombre convenable de navires pour la surveillance des mers, outre 200 000 Livres par an, destinées à  régler les autres coûts nécessaires de l’administration et autres dépenses du gouvernement, financées par les droits de douane et par d’autres moyens déterminés d’un commun accord par le Lord Protecteur et le Conseil. Cette somme ne pourra pas être supprimée ou diminuée, ni les modalités de sa perception modifiées sans l’agrément du Lord Protecteur et du Parlement.

|XXVIII. That the said yearly revenue shall be paid into the public treasury, and shall be issued out for the uses aforesaid.

|XXVIII. Le revenu annuel précité sera payé au Trésor public et sera affecté au financement des usages susmentionnés.

|XXIX. That in case there shall not be cause hereafter to keep up so great a defence both at land or sea, but that there be an abatement made thereof, the money which will be saved thereby shall remain in bank for the public service, and not be employed to any other use but by consent of Parliament, or, in the intervals of Parliament, by the Lord Protector and major part of the Council.

|XXIX. S’il ne s’avère plus nécessaire de conserver des forces de défense aussi importantes, sur terre comme sur mer, et qu’une réduction de leur effectif est envisageable, l’argent ainsi économisé demeurera en réserve pour l’utilité publique et ne sera pas utilisé à  une autre fin, si ce n’est avec le consentement du Parlement ou, dans les intervalles entre deux Parlements, du Lord Protecteur et de la majorité du Conseil.

|XXX. That the raising of money for defraying the charge of the present extraordinary forces, both at sea and land, in respect of the present wars, shall be by consent of Parliament, and not otherwise: save only that the Lord Protector, with the consent of the major part of the Council, for preventing the disorders and dangers which might otherwise fall out both by sea and land, shall have power, until the meeting of the first Parliament, to raise money for the purposes aforesaid; and also to make laws and ordinances for the peace and welfare of these nations where it shall be necessary, which shall be binding and in force, until order shall be taken in Parliament concerning the same.

|XXX. La perception de l’argent destiné à  supporter le coût du financement des forces extraordinaires actuellement mobilisées, à  la fois sur terre et sur mer, pour faire face aux conflits en cours, sera autorisée par le seul Parlement. Le Lord Protecteur, après accord de la majorité du Conseil, pour prévenir les désordres et les dangers qui pourraient autrement se présenter sur mer et sur terre, aura, toutefois, le pouvoir, jusqu’à  la réunion du premier Parlement, de lever cet argent pour les buts indiqués et d’édicter, en cas de nécessité, des lois et des ordonnances pour la paix et le bien-être de ces Nations qui produiront effet contraignant jusqu’à  intervention du Parlement sur le même sujet.

|XXXI. That the lands, tenements, rents, royalties, jurisdictions and hereditaments which remain yet unsold or undisposed of, by Act or Ordinance of Parliament, belonging to the Commonwealth (except the forests and chases, and the honours and manors belonging to the same; the lands of the rebels in Ireland, lying in the four counties of Dublin, Cork, Kildare, and Carlow; the lands forfeited by the people of Scotland in the late wars, and also the lands of Papist and delinquent in England who have not yet compounded), shall be vested in the Lord Protector, to hold, to him and his successors, Lords Protectors of these nations, and shall not be alienated but by consent in Parliament. And all debts, fines, issues, amercements, penalties and profits, certain and casual, due to the Keepers of the liberties of England by authority of Parliament, shall be due to the Lord Protector, and be payable into his public receipt, and shall be recovered and prosecuted in his name.

|XXXI. Les terres, tenures, rentes, redevances, juridictions et propriétés héréditaires non encore vendues ou dont il n’a pas encore été disposé par une loi ou une ordonnance du Parlement, propriété de la République (sauf les forêts et réserves de chasse et les seigneuries et manoirs, les terres des rebelles en Irlande se trouvant dans les comtés de Dublin, Cork, Kildare et Carlow, les terres confisquées au peuple d’Écosse lors des dernières guerres, et les terres de papistes et de délinquants religieux en Angleterre, dès lors qu’ils ne sont pas venus à  composition) seront attribuées au Lord Protecteur pour qu’ils les détiennent, lui et ses successeurs Lords Protecteurs de ces Nations, et ne pourront être aliénées qu’avec l’accord du Parlement. |XXXII. That the office of Lord Protector over these nations shall be elective and not hereditary; and upon the death of the Lord Protector, another fit person shall be forthwith elected to succeed him in the Government; which election shall be by the Council, who, immediately upon the death of the Lord Protector, shall assemble in the Chamber where they usually sit in Council; and, having given notice to all their members of the cause of their assembling, shall, being thirteen at least present, proceed to the election; and, before they depart the said Chamber, shall elect a fit person to succeed in the Government, and forthwith cause proclamation thereof to be made in all the three nations as shall be requisite; and the person that they, or the major part of them, shall elect as aforesaid shall be, and shall be taken to be, Lord Protector over these nations of England, Scotland and Ireland, and the dominions thereto belonging. Provided that none of the children of the late King, nor any of his line or family, be elected to be Lord Protector or other Chief Magistrate over these nations, or any of the dominions thereto belonging. And until the aforesaid election be past, the Council shall take care of the Government, and administer in all things as fully as the Lord Protector, or the Lord Protector and Council are enabled to do.

|XXXII. La fonction de Lord Protecteur de ces Nations sera élective et non héréditaire. À la mort du Lord Protecteur, une autre personne idoine sera aussitôt élue pour lui succéder à  la tête du gouvernement. Cette élection sera faite par le Conseil, qui, immédiatement après le décès du Lord Protecteur, se réunira dans la salle où il siège ordinairement et, ayant informé tous les membres de la raison de sa réunion, procédera, dès lors qu’un quorum de treize est atteint, à  l’élection. Les conseillers ne quitteront la salle de réunion qu’après avoir élu une personne de qualité comme successeur et veilleront à  ce que cette élection soit proclamée dans les trois Nations, comme cela est requis. La personne que le Conseil ou la majorité de ses membres désignera ainsi sera et devra être considérée comme Lord Protecteur de ces Nations d’Angleterre, d’Écosse et d’Irlande et de leurs dépendances. Aucun des enfants du défunt roi, ni aucune personne de sa lignée ou famille ne pourra cependant être élu Lord Protecteur ou à  la magistrature suprême de ces Nations ou d’une de leurs dépendances. |XXXIII. That Oliver Cromwell, Captain - General of the forces of England, Scotland and Ireland, shall be, and is hereby declared to be, Lord Protector of the Commonwealth of England, Scotland and Ireland, and the dominions thereto belonging, for his life.

|XXXIII. Olivier Cromwell, Capitaine général des forces armées d’Angleterre, d’Écosse et d’Irlande, sera et est, par le présent texte, déclaré être Lord Protecteur à  vie de la République d’Angleterre, d’Écosse et d’Irlande et de leurs dépendances.

|XXXIV. That the Chancellor, Keeper or Commissioners of the Great Seal, the Treasurer, Admiral, Chief Governors of Ireland and Scotland, and the Chief Justices of both the Benches, shall be chosen by the approbation of Parliament; and, in the intervals of Parliament, by the approbation of the major part of the Council, to be afterwards approved by the Parliament.

|XXXIV. Le Chancelier, le Gardien ou les commissaires du Grand sceau, le Trésorier, l’Amiral, les Gouverneurs généraux d’Irlande et d’Écosse et les présidents des deux Cours (Court of Common Pleas et Upper Bench) seront choisis par le Parlement et, dans l’intervalle entre deux Parlements, par la majorité du Conseil, sous réserve d’une approbation parlementaire ultérieure.

|XXXV. That the Christian religion, as contained in the Scriptures, be held forth and recommended as the public profession of these nations; and that, as soon as may be, a provision, less subject to scruple and contention, and more certain than the present, be made for the encouragement and maintenance of able and painful teachers, for the instructing the people, and for discovery and confutation of error, hereby, and whatever is contrary to sound doctrine; and until such provision be made, the present maintenance shall not be taken away or impeached.

|XXXV. La religion chrétienne, telle que contenue dans les Écritures, sera proclamée et prescrite comme foi publiquement professée par ces Nations. Le plus rapidement possible, une disposition législative, moins sujette à  scrupule comme à  contestation et plus certaine que celle actuellement en vigueur, sera édictée pour l’encouragement et le maintien de pasteurs capables et se donnant de la peine pour l’instruction du peuple ainsi que pour la découverte et la réfutation de l’erreur et de tout ce qui est contraire à  une saine doctrine. Jusqu’à  ce moment, l’entretien dont ils bénéficient actuellement ne sera pas supprimé ou contesté.

|XXXVI. That to the public profession held forth none shall be compelled by penalties or otherwise; but that endeavours be used to win them by sound doctrine and the example of a good conversation.

|XXXVI. Personne ne sera contraint de professer publiquement la foi ainsi proclamée sous peine de sanction. Les tentatives de gagner ceux ne s’y soumettant pas consisteront en une saine doctrine et dans l’exemple d’une conversation de qualité.

|XXXVII. That such as profess faith in God by Jesus Christ (though differing in judgment from the doctrine, worship or discipline publicly held forth) shall not be restrained from, but shall be protected in, the profession of the faith and exercise of their religion; so as they abuse not this liberty to the civil injury of others and to the actual disturbance of the public peace on their parts: provided this liberty be not extended to Popery or Prelacy, nor to such as, under the profession of Christ, hold forth and practice licentiousness.

|XXXVII. Ceux qui professent la foi en Dieu par Jésus Christ (quoique différant en leur jugement de la doctrine, du rite ou de la discipline publiquement proclamés) ne subiront aucune limite, mais, au contraire, seront protégés dans la profession de leur foi et dans l’exercice de leur religion, dès lors qu’ils ne font pas un usage abusif de cette liberté au détriment des autres et n’occasionnent pas de troubles à  l’ordre public. Cette liberté ne bénéficiera pas aux Catholiques et aux Épiscopaliens, ni à  ceux qui, sous couvert de professer le Christ, proclament et pratiquent la licence.

|XXXVIII. That all laws, statutes and ordinances, and clauses in any law, statute or ordinance to the contrary of the aforesaid liberty, shall be esteemed as null and void.

|XXXVIII. Toutes les lois et ordonnances ainsi que les clauses dans n’importe quelle loi et ordonnance contraires à  ladite liberté devront être tenues pour nul et de nul effet.

|XXXIX. That the Acts and Ordinances of Parliament made for the sale or other disposition of the lands, rents and hereditaments of the late King, Queen, and Prince, of Archbishops and Bishops, &c., Deans and Chapters, the lands of delinquents and forest - lands, or any of them, or of any other lands, tenements, rents and hereditaments belonging to the Commonwealth, shall no wise be impeached or made invalid, but shall remain good and firm; and that the securities given by Act and Ordinance of Parliament for any sum of sums of money, by any of the said lands, the excise, or any other public revenue; and also the securities given by the public faith of the nation, and the engagement of the public faith for satisfaction of debts and damages, shall remain firm and good, and not be made void and invalid upon any pretence whatsoever.

|XXXIX. Les lois et les ordonnances du Parlement adoptées en vue de la vente et autres procédés permettant de disposer des terres, rentes et propriétés perpétuelles du défunt roi, de la reine, des archevêques et évêques, &c., doyens et chapitres, les terres des délinquants religieux et les forêts, les tenures, les rentes et les propriétés héréditaires appartenant à  la République ne seront pas mises en cause ou privées de validité, mais demeureront valables et définitives. Les garanties constituées par ces terres, le montant des droits sur la consommation ou tout autre revenu public, en vertu de tels actes, en contrepartie de sommes d’argent, celles données par la promesse publique de la Nation et engagement de cette dernière à  s’acquitter de ses dettes et à  réparer les dommages causés demeureront valables et définitives et ne seront pas annulées ou déclarées invalides, sous un quelconque prétexte.

|XL. That the Articles given to or made with the enemy, and afterwards confirmed by parliament, shall be performed and made good to the persons concerned therein; and that such appeals as were depending in the last Parliament for relief concerning bills of sale of delinquent's estates, may be heard and determined the next Parliament, any thing in this writing or otherwise to the contrary notwithstanding.

|XL. Les articles de paix consentis ou conclus avec l’ennemi et ratifiés par le Parlement seront exécutés et mis en œuvre en faveur des personnes s’y trouvant visées. Les recours pendants devant le dernier Parlement sollicitant l’abrogation de projets de loi autorisant la vente des biens des délinquants religieux peuvent être plaidés et examinés par le prochain Parlement, en dépit de toute disposition contraire.

|XLI. That every successive Lord Protector over these nations shall take and subscribe a solemn oath, in the presence of the Council, and such others as they shall call to them, that he will seek the peace, quiet and welfare of these nations, cause law and justice to be equally administered; and that he will not violate or infringe the matters and things contained in this writing, and in all other things will, to his power and to the best of his understanding, govern these nations according to the laws, statutes and customs thereof.

|XLI. Chaque Lord Protecteur de ces Nations jurera solennellement devant le Conseil et toutes autres personnes que ce dernier aura convoquées qu’il poursuivra la paix, la tranquillité et le bien-être de ces Nations, qu’il veillera à  ce que la loi et la justice soient appliquées sans discrimination, qu’il ne violera, ni ne portera atteinte aux dispositions figurant dans le présent document et que, pour le reste, il gouvernera ces Nations, de toutes ses forces physiques comme intellectuelles, dans le respect de leur droit, de leurs lois et de leurs coutumes.

|XLII. That each person of the Council shall, before they enter upon their trust, take and subscribe an oath, that they will be true and faithful in their trust, according to the best of their knowledge; and that in the election of every successive Lord Protector they shall proceed therein impartially, and do nothing therein for any promise, fear, favour or reward.

|XLII. Tout membre du Conseil, avant son entrée en fonctions, prêtera serment de les exercer honnêtement et fidèlement, suivant ce qui aura été porté à  sa connaissance, et de se prononcer, lors de l’élection du Lord Protecteur, en toute impartialité, sans considération de promesses, de peurs, de faveurs ou de récompenses.
