La Loi CRPR a considérablement élargi les motifs de dissolution administrative des associations et des groupements de fait. Ces contraintes, justifiées par la préservation de l'ordre public, définissent les bornes que les associations ne peuvent franchir, mais elles servent aussi de rempart contre l'intrusion arbitraire des pouvoirs publics en précisant les modalités d'exercice de l'autorité administrative. Cet article interroge la portée de la limite imposée par l’article L212-1CSI : présente-il une dimension protectrice et structurante, ou s’apparente-il uniquement à un mécanisme de répression ? L’étude de la jurisprudence du Conseil constitutionnel et du Conseil d’État conclut au caractère poreux de cette limite, dont l’interprétation représente à présent un potentiel danger pour la liberté d’association.  

The CRPR Law has significantly broadened the grounds for the administrative dissolution of associations and de facto groups. These constraints, justified by the preservation of public order, define the limits that associations cannot cross, but they also serve as a bulwark against arbitrary intrusion by public authorities by specifying the procedures for exercising administrative authority. This article examines the scope of the limit imposed by Article L212-1 of the Internal Security Code: does it have a protective and structuring dimension, or is it merely a mechanism of repression? A review of the case law of the Constitutional Council and the Council of State concludes that this limit is porous, and its interpretation now represents a potential threat to freedom of association.
